The following are additional terms & conditions by which Creative Sports, 10006 N,
Dale Mabry, Suite 215, Tampa, FL 33618 (“Distributor”), in consideration of a
Participant’s/Traveler’s payment, agrees to provide these travel tours. Please read
carefully before sending any deposits or payments.
RESERVATIONS: Payment of deposit must be accompanied by a signed reservation form or
invoice. Distributor reserves the right to decline, accept, or retain any person as a
member for a tour at any time or to change or to withdraw the tour if necessary.
All prices are subject to change without notice, prior to a confirmation of order.
Written confirmation is mailed upon receipt of required payments.
METHOD OF PAYMENT: Payment should be made to your travel agent or to Creative Travel
Group. Our intention is to provide you with the sports package you have purchased, at
the price in effect at the time of the booking. Payments must be made in the form of
cashier’s check, money order, credit card, or wire transfer. Consent is hereby given to
allow the Distributor to process the participant’s credit card for the amount of the
agreed package and as such, the participant waives their right to charge back any amounts.
The applicable portion of your payment related to air travel will be deposited into escrow.
The remaining balance will be used to secure accommodations, transfers, and components of your tour.
A late payment charge of $25.00 may be assessed if final payment is not received by scheduled date.
CANCELLATIONS & REFUNDS: All deposits are non-refundable unless specified team does not
enter the competition or otherwise directly stated in signed contractual agreement.
In the event of a “no show”, the total tour price is forfeited. Except for “major changes”
as described below, all payments are non-refundable within 30 days of commencement of
package, and no refunds will be made for any portion of the tour price that you
voluntarily do not use. In the event of cancellation or postponement of a certain event,
Distributor shall not be responsible for accommodations or transportation beyond the
scheduled date of a certain event. In the event of a reduction in group size,
corresponding deposits of cancelled passenger blocks are non-refundable and
non-transferable (e.g. to the balance of the remaining group). The Distributor reserves
the right to cancel, as its sole option, any reservation. If a reservation is cancelled
without cause attributable to participant, a full refund will be remitted to cancelled
party. No refunds will be given in the event the game is rained out. However,
participant/client will be able to keep their game day tickets if they so desire.
The following are major changes: (1) a change in departure or return date, unless the
change results from a flight delay experienced by the air carrier, (2) price increase
of more than 10 percent occurring 10 or less days before departure. In no event can we
increase your price less than 10 days before departure. If a major change must be made
in the tour, we will notify you within 7 days after first learning of the change, but in
any event at least 10 days prior to the scheduled departure. If less than 10 days before
scheduled departure we become aware that a major change must be made, we will notify you
as soon as possible. Within 7 days after receiving notification of a major change, but in
no event later than departure, you may cancel your reservation and you will receive a
full refund.
CHANGING YOUR RESERVATION: A $50.00 per person fee is charged for any changes made prior
to the departure. The Distributor will do its best to accommodate your needs.
DOCUMENTS: When feasible, travel documents are issued two weeks prior to departure. The
passenger is responsible for providing proper identification. Contact your travel agent
for full details. Passenger(s) denied boarding due to improper documentation will not
receive any refund.
INSURANCE: Due to the stringent cancellation restrictions and the risk of lost or damaged
luggage, we strongly recommend the purchase of trip, health, accident, auto, baggage,
and Cancellation insurance.
RESPONSIBILITY: Hotel, transportation, Rental Car, and Services: In providing this tour, the Distributor, through independent third-party distributors, arranges for certain
services and accommodations offered in connection with the tour. The Distributor, its
agents, director, officers, and employees shall not be held liable for any claims,
actions, cause of action, injuries, damages, loss, delays, or expenses, arising out of or
resulting from any of the following: Any act or omission of a third-party contractor
supplying services on the tour including, but not limited to, air, land, or water
transportation services, any act or omission of any third-party contractor supplying
accommodations or event tickets on the tour, quarantine, strikes, force majeure, the
failure of aircraft, watercraft, or any other means of transportation to arrive
or depart as scheduled, disturbances, government restrictions or regulations,
discontinuance or changes in transit or hotel services or any other cause over which
the Distributor has no direct control. The accommodations shall be on the run of the
house basis. In the event that the services and accommodations set forth in this
package can not be supplied for any reason, the only obligation of the Distributor shall
be to use its best efforts to supply comparable services and accommodations within the
hotel category chosen. Grading of hotels and services on these tours is in accordance
with standard industry practice and you, as a tour participant, accept such grading
when booking these tours. The rights and remedies made available under this contract
are in addition to any other rights or remedies available under applicable law. However,
we offer refunds under this contract with the express understanding that the acceptance
of any refund or alternate arrangement shall be final. Your booking and execution of
this document shall constitute consent to the conditions set forth herein as well as
all other terms and conditions of this package. The participant acknowledges these
conditions and agrees to hold the company blameless in making the arrangements on
his/her behalf, and agrees that restitution or damages, if any are claimed, shall be
sought directly from suppliers.
TICKETS TO EVENTS: Tickets to all events will be issued on location unless otherwise
stated in writing. For odd numbers or groups of more than two people, tickets can not be
guaranteed together, nor can specific rows or sections. If tickets are required prior to
said time, a surcharge relative to advance time will be assessed. Upgraded seating may be
available upon request at an additional cost. In the event of ticket disruption,
Distributor’s sole responsibility and liability is reimbursement of face value of ticket.
NOTICE REGARDING TICKETS: The Distributor obtains tickets for events in various forms
and at different time periods. The Distributor is not necessarily in physical possession
of admission tickets at the time a booking is made or accepted. Federal regulations
govern special event tours whom interstate or foreign air transportation is involved.
In situations where the Distributor is not in physical possession of tickets to an event
at the time of booking or an equivalent (such as a voucher) or contracts defined by the
pertinent federal regulations, booking may not be accepted without a specific written
acknowledgement form from the participant, client, passenger setting forth the specific
terms and conditions applicable to that tour.
100% SATISFACTION GUARANTEE: The product promoted is available as such. If not delivered,
100% of that portion of the tour will be refunded to the customer.
